KVKK Privacy Notice

In accordance with Article 10 of the Turkish Personal Data Protection Law No. 6698 (KVKK), we explain how the personal data you send us through our website is processed.

1. Data controller

Your personal data is processed by the following company acting in the capacity of data controller:

2. The personal data we process

On our website we collect data only through our contact and quote forms. Unless you fill in a form or give cookie consent, none of your personal data is processed (for cookies, see section 6). When you submit the form, the data processed is as follows:

  • Identity and contact details: full name, company name, e-mail address, phone number (optional)
  • Content of the request: the subject and/or application you select, and the message you write as free text
  • Transaction security data: the IP address the request was sent from, the date and time of submission, and the language of the page on which the form was completed

3. Purposes of processing

Your data is processed solely for the following purposes:

  • Evaluating and responding to the requests, questions, sample and quote inquiries you send us
  • Preparing a product and process recommendation suited to your request and, where necessary, enabling our technical team to contact you
  • Conducting pre-contractual negotiations should a commercial relationship be established
  • Preventing misuse of the form by automated software (bots) and ensuring transaction security

We do not use your data for marketing purposes, we do not sell it to third parties, and we do not add you to our commercial electronic message lists without your explicit consent.

4. Legal grounds and method of collection

Your personal data is collected electronically and by wholly automated means when you complete and submit the form on our website. The legal grounds for processing are as follows:

  • Article 5/2-c of the KVKK: processing is directly related to the conclusion or performance of a contract (quote and sample requests)
  • Article 5/2-f of the KVKK: processing is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (being able to respond to incoming requests, ensuring transaction security)
  • Article 5/1 of the KVKK: your explicit consent — for analytics cookies only, if you select “Accept” in the consent bar at the bottom of the page. You may withdraw your consent at any time.

5. Transfer of data

Your data may be transferred to the suppliers whose services we use, limited solely to the purposes set out above:

  • E-mail service: notifications from the form are delivered to our corporate e-mail account. Our e-mail infrastructure is provided by Google (Google Workspace).
  • Hosting service: the servers on which our website and form infrastructure run are operated by our service provider.
  • Web analytics service: if you give cookie consent, statistical data on your use of the site (pages visited, device and browser information, approximate location, IP address) is transferred to Google via Google Tag Manager and Google Analytics.

Transfer abroad

The servers of the providers from which we receive e-mail, hosting and (with your consent) web analytics services may be located abroad. For this reason, your personal data may be transferred abroad within the scope of Article 9 of the KVKK and limited solely to the purposes set out above. Such transfers are carried out within the framework of the contracts concluded with the service providers and the safeguards prescribed by the legislation.

Apart from these, your data may only be transferred to public institutions and organizations legally authorized to receive it, for the purpose of fulfilling a legal obligation.

6. Cookies

Our website does not set any cookies without your consent and does not transmit data to third-party services as a result of your viewing the pages. Only if you select “Accept” in the consent bar at the bottom of the page are Google Tag Manager and Google Analytics loaded and analytics cookies (_ga, _ga_*) used, in order to understand how the site is used. These cookies are kept for up to 2 years and are not used for advertising or personalisation. Your choice is stored only in your browser; you can change it at any time via the “Cookie preferences” link at the bottom of the page. When you withdraw your consent, the analytics cookies are deleted. Fonts and images are served from our own server.

7. Retention period

The data you send through the form is retained for as long as necessary to evaluate and conclude your request. Should a commercial relationship be established, the retention periods prescribed by the applicable legislation (in particular those relating to commercial books and records) apply. Once these periods expire, your data is deleted, destroyed or anonymized.

8. Your rights under Article 11 of the KVKK

By applying to the data controller, you have the following rights in relation to yourself:

  1. To learn whether your personal data is being processed
  2. To request information if your personal data has been processed
  3. To learn the purpose of processing your personal data and whether it is used in line with that purpose
  4. To know the third parties in Turkey or abroad to whom your personal data has been transferred
  5. To request that your personal data be rectified if it has been processed incompletely or inaccurately
  6. To request the erasure or destruction of your personal data within the conditions set out in Article 7 of the KVKK
  7. To request that rectification, erasure and destruction operations be notified to the third parties to whom the data has been transferred
  8. To object to an outcome to your detriment that arises from the analysis of the processed data exclusively by automated systems
  9. To claim compensation for damage you suffer as a result of the unlawful processing of your personal data

9. How to apply

You may submit requests concerning the rights listed above, together with information and documents verifying your identity, through the channels below. Depending on the nature of the request, your application is concluded free of charge within thirty days at the latest; if the process also entails a cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.

  • In writing, by a signed written application delivered to our company address
  • From your registered electronic mail (KEP) address or the e-mail address registered in our system, to info@kimfosan.com.tr

10. Changes

This information notice may be revised in line with changes in the legislation or updates to our data processing procedures. The current text is always published on this page.
